Transparency in commercial litigation is an important subject for many reasons. Many of the participants in the process point to the need for more of it. But, in my experience, very few participants in the legal process have the proper incentives to encourage transparency in a given case. Nonetheless, the overall public policy benefits are significant. The need for transparency is now being widely discussed by the profession. As an example, in the US the Sedona Conference Cooperation Proclamation is premised on the benefits of transparency. Of course, any policy decisions about transparency must be balanced with the legitimate privacy needs of the parties, including needs that underlie the attorney-client privilege and work product doctrines.
